A No. 988 of 2026 __________Page 2 of 5 For Respondent(s): Mr.K.Sukumaran Order This application is filed to strike off the 4th Defendant from the Plaint in C.S.No.293 of 2024. 2.The reason stated in the support affidavit is that the 4th defendant is only a developer and in no way connected with the suit and he is an unnecessary party. 3.The only contention raised by the respondent in the counter affidavit is that the application ought to have been filed at the earliest possible opportunity. The said contention cannot be accepted and it has to be seen only whether 4th defendant is a necessary party to the suit. This Court is of the view that the 4th defendant is neither a necessary nor a proper party in the suit. Accordingly, the application is allowed. 4.The plaintiff is directed to amend the plaint by removing the name of the 4th defendant in the cause title. 5.List the case on 28.08.2026 for framing additional issues
