Karthikeyan Additional Government Pleader for R1 and R2 Mr. Durai Gunasekaran Government Counsel (Crl.Side) for R3 ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents to consider and dispose of the petitioner's representation dated 20.06.2026, to conduct a survey, fix the boundaries, and provide necessary police protection for the petitioner's land situated at No. 64/8, Pillayar Kovil Street, Salem Taluk, Salem, comprised in Block No. 21, T.S. No. 59, measuring a total extent of 71.5 sq. mts. 2. When the matter was taken up for hearing today, the learned Additional Government Pleader appearing for respondents 1 and 2 submitted that the revenue authorities have already acted upon the representation and issued summons for the survey, which is scheduled to be conducted on 27.08.2026 with requisite police protection. __________ Page2 of 5 https://www.mhc.tn.gov.in/judis WP No. 32935 of 2026 3. In view of the submission made by the learned Additional Government Pleader, it is evident that the respondents have already initiated action on the petitioner’s representation dated 20.06.2026. Recording the said submission, this Writ Petition is disposed of with a direction to the respondents to complete the survey and demarcation exercise within a period of four (4) weeks from the date of receipt of a copy of this order. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. 4. With the above directions, this Writ Petition stands disposed of.
