JUSTICE P SREE SUDHA ORAL ORDER Heard the arguments of learned counsel for the petitioner and learned counsel for the respondent. 2. This civil petition is filed by the wife for transfer of M.C.No.446/2025, filed by the husband for restitution of conjugal rights, from Family Court, Davanagere to Principal Family Court Judge, Shivamogga. - 3 - HC-KAR NC: 2026:KHC:16635 CP No. 443 of 2025 3. It is stated that the marriage between the petitioner and respondent was performed in the year 2022 and out of their wedlock they have a child aged 8½ months. It is stated that both the petitioner and respondent are Software Engineers working in Bangalore and presently petitioner is on maternity leave. Learned counsel for the petitioner stated that the petitioner is residing in Nyamathi and distance between Davanagere and Nyamathi is 65 kilometres but the distance between Nyamathi and Shivamogga is 30 kilometres and thus she requested for transfer to Shivamogga. 4. Learned counsel for the respondent stated that both of them are working at Bangalore and they may be permitted to appear virtually. It is stated that petitioner is residing with her parents and her brother is also working in Bangalore. The distance between Nyamathi and Davanagere is only 61 kilometres. Therefore, her request for transfer to other Court which is at a distance of 30 kilometres is not proper and this Court finds that there are - 4 - HC-KAR NC: 2026:KHC:16635 CP No. 443 of 2025 no merits in the transfer petition and accordingly, the petition is dismissed. However, both petitioner and respondent are at liberty to file their chief affidavit and they can be cross-examined through a Commissioner or by way of video conferencing facility.
