ORDER 07.05.2026 [1] Heard Ms. J. Akhtar, the learned counsel for the applicant. Also heard Mr. R. Sharma, the learned counsel for the insurance company. [2] This interlocutory application has been filed by the applicant/claimant in connection with MAC Appeal No. 474/2019, seeking correction of an accidental slip that has crept in the order dated 09.03.2024, passed by a co-ordinate bench of this court (Hon’ble Mrs. Justice Malasri Nandi since retired) in MACAppeal No. 474/2019, wherein, in line Nos. 3 and 4 of paragraph No. 2 of the said order, it has been stated that an amount of Rs.
Page No.# 3/4 1,58,339/- has already been deposited by the insurance company before the Registry. [3] It is submitted by the learned counsel for the applicant that said fact has been wrongly mentioned as the insurance company is yet to deposit the said amount before the Registry and therefore, the said error is required to be rectified. [4] The learned counsel for the insurance company also agrees and submit that the amount of Rs. 1,58,000/- has not yet been deposit by the insurance company and it is ready to deposit the same before the Motor Accident Claims Tribunal, Bongaigaon if the court directions it to do so. [5] Considering the submissions made by the
learned counsel, the error pointed out by the applicant in
order dated 09.03.2024, passed in MAC Case No. 474/2019 is required to be rectified. Accordingly, the phrase”has been deposited by the insurance company before the Registry” shall be read as “has to be deposited by the insurance company before the Motor Accident Claims Tribunal, Bongaigaon, as expeditiously as possible. [6] This interlocutory application is, accordingly, disposed of.
