BH RAMA KRISHNA NAIK The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO CONTEMPT CASE No.354 of 2025 ORDER: This Court, while disposing W.P.No.29432 of 2024, directed the respondents to adhere to the procedure, as established under law, if at all they intend to evict the petitioners from their respective stalls. 2. Learned counsel for the petitioners would submit that petitioners have been evicted without following due process of law. 3. Learned counsel for the respondents would submit that petitioners were evicted prior to filing of the writ petition and the respondents have not violated the orders of this Court, as alleged by the petitioners. 4. Learned counsel for respondents tried to convince this Court by filing proceedings, which do not indicate the shop numbers. 5. Admittedly, the respondents have evicted the contempt petitioner without adhering to the direction issued by this Court, as per the proceeding placed before this Court across the Bench. Thus, the respondents have violated the order of this Court. 6. However, to meet the ends of justice the respondents are directed to pay Rs.5,000/- (Rupees Five Thousand only) to the petitioners within a period of three(03) weeks from the date of receipt of a copy of this order. The said payment is not a fine as envisaged under Section 12 of the Contempt of Courts Act. 4 7. With the above observation, the present Contempt Case is closed.
