This L.P.A. challenges the learned Single Judge’s order dated 19.11.2025, dismissing the appellant’s W.P.(S) No. 6457 of 2025, questioning the communication dated 27.05.2025, issued by the Executive Engineer (R-4) requesting M/s Raider Security Services Pvt. Ltd, the employer of the petitioner, to take back her services, as the Department was not satisfied with her performance as a Peon. ( 2026:JHHC:10776-DB ) 2 3. The records shows that the petitioner was the employee of M/s Raider Security Services Pvt. Ltd. In terms of the agreement between the Government and the M/s Raider Security Services Pvt. Ltd, the work of providing Peons etc. was outsourced to M/s Raider Security Services Pvt. Ltd. 4. Admittedly, M/s Raider Security Services Pvt. Ltd is not a ‘State’ under Article 12 of the Constitution. There are no averments to this effect in the memo of appeal. The contention that the agreement with the Government converts M/s Raider Security Services Pvt. Ltd into a ‘State’ under Article 12 of the Constitution, or that the employees of M/s Raider Security Services Pvt. Ltd, who, worked with the Government, acquire any statutory status, is quite misconceived and has been correctly rejected by the learned Single Judge. 5. We see no error in the view taken by the learned Single Judge in the facts of this matter and, therefore, dismiss this appeal. No costs. (M.S. Sonak, C.J.) (Rajesh Shankar, J.)
