She claims that she came to contact with the first petitioner when they were working together and alleges that the marriage was performed and they are living together and subsequently, the first accused deserted and went to his home. When she tried to confront him, she was abused by her caste name and also that other abuses were made and hence the case. 3. The learned counsel for the petitioners would submit that the marriage itself did not take place. He would submit that even the allegations is abused with the caste name over phone. The third submission is that there is no material as far as the second and third petitioners are concerned. I am unable to accept the said submissions because the same were made on factual averments that the case is false. The same has to be established during the course of the trial.
The de-facto complainant has made specific averments that she went in person and there also the abuse had happened. Therefore, it is for the petitioners to establish their case during the course of the trial, it is that no marriage happened and that no such abuse had happened etc. Finding no merits, the Criminal Original Petition stands disposed of. Consequently, connected Miscellaneous Petition(s) if any, is/are closed. 4. Considering the hardship that is pleaded, the personal appearance of the second and third petitioners alone before the trial Court shall stands dispensed with, except for the necessary hearings that are insisted upon by the https://www.mhc.tn.gov.in/judis
