Order 06/03/2026
1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.273/2025 registered at Police Station Alwar Gate, District Ajmer for offences under Sections 115((2), 126(2) and 74 of BNS, 2023.
2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. It is further submitted that the petitioners are facing charges for allegedly inflicting life-threatening injuries to the injured Rahul. It is further submitted that from the statement recorded under Section 180
[2026:RJ-JP:9735] (2 of 2) [CRLMB-3562/2026] BNSS and from the analysis of the CCTV footage, it appears that no specific act has been attributed to the present petitioners. It is the co-accused Satya Narayan to whom the specific act causing life-threatening injuries has been attributed. Petitioners are behind the bars since 26.12.2025 without any criminal past. The trial will take considerable long time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and the bail application of the petitioners may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Sunny Kumar S/o Shri Satyanarayan & Vikki Bairwa S/o Late Shri Hansraj, shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before the Court on all the dates till conclusion of the trial.
