ABLAPL No.479 of 2026
Siba Sankar Patra …. Petitioner
Mr. M.K. Chand, Advocate
-Versus- State of Odisha …. Opposite Party
Mr. S.K. Lenka, ASC
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 27.01.2026
01.
1. Heard learned counsel for the petitioner and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Nachuni P.S. Case No.354 of 2024 corresponding to G.R. Case No.549 of 2024 pending in the court of learned J.M.F.C., Banpur on the grounds stated.
3. Gone through the FIR at Annexure-1 and it reveals recovery and seizure of fire crackers, details of which are mentioned therein. The submission of learned counsel for the petitioner is that the present accused does not have any antecedent. It is however fairly submitted that the petitioner is alleged to be responsible for storage of the fire crackers without any authority or license. Recorded the objection of the State. Since the alleged recovery and seizure has already taken place with regard to the fire crackers and it was from the possession of the petitioner, who claimed to have no other similar p. 2 antecedent with any case registered against him, this Court though not inclined to grant pre-arrest bail to him but is of the view that he should be directed to surrender before the learned court below for being released with stringent conditions and subject to verification and absence of similar antecedent.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is directed that in the event, the petitioner surrenders before learned J.M.F.C., Banpur in connection with Nachuni P.S. Case No.354 of 2024 corresponding to G.R. Case No.549 of 2024 within fifteen days from today, he shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed besides the following, such as, he shall not be involved in any such criminal activities after being released and to co-operate the IO in the investigation, till the same is over. It is further
directed that the above order shall not be given effect to if the petitioner, upon an enquiry/verification by the learned court below, is found to have antecedent of similar nature.
6. Issue urgent certified copy of this order as per rules.
