The instant appeal has been filed under Section 14A SC/ST (Prevention of Atrocities) Act, 1989 on behalf of the appellants, who are in custody in connection with FIR No.204/2025 at Police Station Bansur, District Kotputli-Behror for the offences under Sections 189(2), 115(2), 126(2), 303(2), 351(2) of the BNS, 2023 [2026:RJ-JP:13145] (2 of 3) [CRLAS-327/2026] and Sections 3(2)(va) of the SC/ST (Prevention of Atrocities) Act, 1989. 2. Learned counsel for the accused-appellants has submitted that the appellants are young persons, both aged about 21 years. It is submitted that there are no criminal antecedents registered against the appellants and that the appellants have been in custody since 06.12.2025. 3. Per contra, learned Public Prosecutor has opposed the instant appeal. Despite the service, none has marked appearance on behalf of the complainant. 4. Having heard the arguments advanced by learned counsel for the parties, considering the fact that the appellants are young persons, aged about 21 years; that there are no criminal antecedents registered against the appellants; that the appellants have been in custody since 06.12.2025, and looking to the overall facts and circumstances of the case and material available on record but without commenting on merits/demerits of the case, this Court is inclined to allow the bail application of the accused- appellants and enlarge them on bail. 6. Consequently, the instant appeal is allowed. The impugned order dated 28.01.2026 passed by the Special Judge, SC/ST (Prevention of Atrocities) Cases, Alwar is set aside. It is ordered that the accused-appellants Amit Kumar Boora son of Mahesh Chand Jat & Anurag Singh Boora son of Hukam Singh arrested in connection with aforesaid FIR, shall be released on bail, if not wanted in any other case, provided they furnish a personal bond of Rs.50,000/- each and two sureties of [2026:RJ-JP:13145] (3 of 3) [CRLAS-327/2026] Rs.25,000/- each to the satisfaction of the learned Trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
