2. Mr. Chitrarth Kandpal, learned Brief Holder, for the State of Uttarakhand.

In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Vikas Mandal, who has been accused in Case Crime No.260 of 2025, under Sections 65 (1) of BNS, and under Sections 5(j)(ii)/6 of the POCSO Act, at Police Station Rishikesh, District Dehradun.

As per the case of the prosecution that on 30.05.2025, the Complainant i.e. maternal uncle of the victim, lodged an FIR against the Applicant with the allegations that his niece/Bhanji i.e. victim aged about 15 years, was in relationship with the Applicant and the Applicant had established forcible physical relationship with his niece and consequent to it, the victim is three months pregnant and is admitted in AIIMS, Rishikesh, presently.

Learned counsel for the Applicant submits that the Applicant has been falsely implicated in the present matter. He further submits that the Applicant has not previously convict and the Applicant has been languishing in jail since
31.05.2025.
6. Learned State Counsel has vehemently opposed the bail application of the Applicant on the ground that the victim is a minor girl whose date of birth is 21.02.2010.
7. Considering the overall facts and circumstances of the case, the Applicant has not made out a case for bail. Consequently the bail application of the Applicant – Vikas Mandal, is hereby rejected in connection with the Case Crime No.260 of 2025, under Sections 65 (1) of BNS, and under Sections 5(j)(ii)/6 of the POCSO Act, at Police Station Rishikesh, District Dehradun.
