ORDER: (Per Hon’ble Smt Justice Sunitha Gandham)
This Writ Petition is filed to declare the action of the respondents in issuing the notice dated 28.01.2026 by the 2nd respondent to the petitioners to vacate the residential house bearing D.No.18/167 admeasuring 304 Sq.yds, situated at Sukarlabad, Ward No.18, Machilipatnam, Krishna District and hand over the physical possession to them as illegal, arbitrary and unconstitutional and consequently direct the respondents to grant six months time to vacate and handover the physical possession of the subject property.
2. Heard learned counsels for the petitioners and respondents.

When the matter is taken up for arguments, learned counsel for the respondents submitted that respondent No.2 has issued impugned notice requesting the petitioner to remove and shift all movable goods/ articles which are lying in the premises without any further notice, but the petitioner failed to do so and thereafter, possession of the subject matter was already taken on 29.04.2023 and to show the same, the learned counsel produced photocopy of panchanama and inventory along with photographs. Learned counsel for respondents finally would submit that this writ petition became infructuous and the respondents are ready to hand over the articles which are mentioned in the inventory.

Learned counsel for the petitioners submitted that by recording the
submissions made by the learned counsel for the respondents, this writ petition may be disposed of.
5. As seen from the panchanama and inventory panchanama in Crl.M.P. No.32 of 2023 in C.F.No.55 of 2023 on the file of Chief Judicial Magistrate at Machilipatnam, the learned advocate commissioner has clearly mentioned floor wise and room wise inventories, got locked and sealed the rooms and handed over the keys to the respondent No.2 herein. Record reveals that delivery was affected on 29.04.2023 itself.

Therefore, this Court is of the considered view that this Writ Petition became infructuous and it is needless to say that the petitioners have to approach the respondents by submitting an application to receive the articles/ goods which are listed in the inventory. The respondents are directed to consider the said application within fifteen (15) days from the date of receipt of such application and hand over the said list of articles under proper acknowledgement.
7. Accordingly, this Writ Petition is dismissed as infructuous. No order as to costs.
