No C548 D618 - 11342 -Do TNSTC (Salem) 2025 dated 16.07.2025 and seeking to quash the same as illegal. 2.The petitioner joined the respondent Corporation as a Reserve Driver in January 2015 and thereafter, by order dated 19.06.2015, was appointed as a regular Driver and allotted Employee No.RD)771. He was subsequently confirmed in service in the year 2022. Since his appointment, he has been discharging his duties with utmost sincerity and diligence. When the petitioner reported for duty on 11.07.2025, to his shock and surprise, he was orally informed that he had been placed under suspension, allegedly on the basis of a complaint said to have been lodged by a passenger on 21.06.2025. However, no written order of suspension was served on him on that date. Despite the alleged oral suspension, the petitioner continued to report for duty, marked his presence through the biometric attendance system, and requested the authorities to allot duty to him. However, the 2nd respondent arbitrarily refused to allot duty to the petitioner, citing the alleged oral suspension. Thereafter, a charge memo dated https://www.mhc.tn.gov.in/judis WP No. 31256 of 2026 __________ Page3 of 6 16.07.2025 was issued and served on 20.07.2025, based on a complaint allegedly given by a passenger on 21.06.2025, framing charges under Clause 29(xxiii) of the Standing Orders of the Corporation. 2.1. The petitioner sought the primary documents relied upon in the charge memo by representation dated 15.09.2025. However, an enquiry notice dated 16.07.2026, served on 20.07.2026, directed him to appear for enquiry on 24.07.2026, without furnishing the requested documents. The 3rd respondent merely stated that the documents could be inspected during the enquiry. Such denial of copies of the relied-upon documents has deprived the petitioner of a fair and reasonable opportunity to prepare his defence and is contrary to the principles of natural justice. Aggrieved by the charge memo dated 16.07.2025, the present writ petition has been filed. 3.The only grievance that has been expressed by the writ petitioner in this writ petition is that, the petitioner has been made to face the disciplinary proceedings without furnishing the requisite documents. The learned counsel would rely upon the communication dated 16.07.2026 to put-forth the case that the documents have not been furnished to him. However, the reading of the same would indicate that the petitioner has been permitted to peruse the documents.
