For Petitioner(s): Mr.K.Balachandar For Respondent(s): Mr.R.S.Indira Government Advocate (Criminal side) ORDER The petitioner apprehends arrest for the alleged offence under Sections 115 (2), 118 (1), 126 (2), 296 (B), 351 (3) BNS Act, in Crime No.85 of 2026 on the file of the respondent police seeks anticipatory bail. 2. The case of the prosecution is that the petitioner waylaid the defacto- complainant, demanded money to drink, abused him using filthy language and attacked him with a knife. Hence, the case. 3. The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution case and upon instructions, submitted that five previous cases have been registered against the petitioner. He further submitted that the occurrence took place on 30.06.2026 whereas the injured person was discharged from the hospital 04.07.2026. Hence, he opposed the grant of anticipatory bail. 5.From the submissions made by the learned Government Advocate (Criminal side), it is pellucid that the petitioner has misused the liberty which had been granted by this Court in earlier point of time. As rightly contended by the learned Government Advocate (Criminal side), the defacto-complainant sustained serious injuries, was hospitalised on 30.06.2026 and was discharged on 04.07.2026.
