2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner lodged a complaint before the Hon’ble President of India and the same was forwarded to the first respondent herein for further action. In turn, the said complaint was forwarded to the fifth respondent and the enquiry is pending.
4. The petitioner, who appeared in person, submits that he was illegally arrested and remanded to judicial custody. At the time of his arrest, no procedures were followed by the sixth respondent. Therefore, the said complaint ought to have been enquired into by an authority other than a police official. Now, the complaint has been forwarded to the fifth respondent, who is an IPS officer. The fifth respondent has nothing to do with the sixth respondent. Therefore, the fifth respondent is competent authority to enquire into the complaint.
5. In view of the above, the fifth respondent is directed to conduct an enquiry, after issuing notice to the petitioner and the sixth respondent and dispose of the complaint within a period of four weeks from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis
