By consent of the parties, the main petition is taken up for disposal in the stage of admission itself. 4. The learned counsel for the petitioner would submit that in this case, the subject property was acquired by virtue of the gift/settlement deed dated 06.04.2026. However, without the knowledge of the petitioner, now, the patta was issued in favour of a 3rd party. Hence, the petitioner filed a representation dated 20.07.2026 before the respondents, requesting them for transfer of patta, pertaining to the subject property, in favour of the petitioner. However, the said representation was not at all considered by the respondents till date. Hence, this petition. 5. In reply, the learned counsel for the respondent would submit that if the petitioner is aggrieved over the wrong issuance of patta in favour of any 3rd party, he is supposed to have filed an application for cancellation of the said patta and for issuance of fresh patta in favour of the petitioner. Instead of doing so, the petitioner had inadvertantly filed a representation for transfer of patta. Hence, he requests this Court to pass appropriate orders. 6. Heard the learned counsel appearing for the petitioner as well as the respondent and also perused the entire materials available on record. https://www.mhc.tn.gov.in/judis WP No. 32326 of 2026 __________ Page4 of 6 7. In the case on hand, the subject property was acquired by virtue of the gift/settlement deed dated 06.04.2026. However, without the knowledge of the petitioner, now, the patta was issued in favour of a 3rd party. Hence, the petitioner filed a representation dated 20.07.2026 before the respondents, requesting them for transfer of patta, pertaining to the subject property, in favour of the petitioner. 8. On the other hand, it was rightly submitted by the respondent that if the petitioner is aggrieved over the wrong issuance of patta in favour of any 3rd party, he is supposed to have filed an application for cancellation of the said patta and for issuance of fresh patta in favour of the petitioner. When such being the case, no direction can be given to the revenue authorities for consideration of the petitioner’s representation, which was given for patta transfer. 9. In view of the above, this Court grants liberty to the petitioner to file a representation for cancellation of existing patta before the 3rd respondent and a representation for issuance of fresh patta before the 4th respondent. In such case, the respondents 3 & 4 shall consider it and after issuing notice to all the concerned parties, dispose of the same, on merits and in accordance with law, within a period of 8 weeks from the date of receipt of said representation. https://www.mhc.tn.gov.in/judis WP No. 32326 of 2026 __________ Page5 of 6 10.
