Mattegunta.Sudhir,Standing Counsel For Z.P.Ps,M.P.Ps,Gram Panchayats SRK,J W.P No.14997 of 2023 3 THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY Writ Petition No:14997 of 2023 The Court made the following Order: This Writ Petition is filed seeking the following relief: “...to issue the Writ order or Direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents 2 to 7 in respect of withholding the payment of amount Rs.2,31,199/-, under 100% share of SDRF ( 2017-18) even after finalizing the bill, payable to the petitioner in relation to the execution of work “FDR to the road from kalluru to @ Km 6/7 Anepudi R and B Road Kalluru Gram Panchayat, Naidupet Mandal, SPSR Nellore District”, as illegal arbitary and contrary to the Principles of Natural Justice and consequently direct the respondents No.2 to 7 to release the amount of Rs.2,31,199/-, for the work for “FDR to the road from kalluru to @ Km 6/7 Anepudi R and B Road Kalluru Gram Panchayat, Naidupet Mandal, SPSR Nellore District” and pass such other order or orders…” 2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Panchayat Raj and Rural Development. 3. The petitioner has executed the work of FDR to the road from Kalluru to Km 6/7 Anepudi R&B Road, Kalluru Gram Panchayat, Naidupet Mandal, SPSR Nellore District, sanctioned under 100% SDRF Scheme vide G.O.Rt.No.784 dated 24.08.2016, with an estimated cost of Rs.2,31,199/-. The petitioner completed the work by arranging funds, the measurements were recorded in the M-Book, the work was inspected and cleared by the competent authorities, and the final bill was prepared. Despite completion of the work and repeated representations, the respondents have withheld the SRK,J W.P No.14997 of 2023 4 admitted amount of Rs.2,31,199/- without any valid reason. It is the case of the petitioner that he borrowed money on interest to execute the work and is suffering serious financial hardship due to non-payment of admitted bill amount. 4. It is the grievance of the petitioner that notwithstanding the completion of the work and its measurement by the competent authorities, the amount due towards the executed work has not been paid till date. According to the petitioner, although the work was completed more than nine years ago, the respondent authorities have not released the admitted amount payable to him. Aggrieved by the non-payment of the said amount, the petitioner filed the present Writ Petition. 5. Learned Assistant Government Pleader, on written instructions dated 11.06.2026, from the Executive Engineer, PRI Division, Gudur, submits that there is no dispute with regard to the execution of the work. According to him, the petitioner is entitled to an amount of Rs.2,31,199/- after statutory recovery (QC recovery) of Rs.61,550/-, and the said amount has to be paid by 8th respondent and six months’ time is sought for payment of the said amount. The written instructions are placed on record. 6. Having regard to the fact that there is no dispute with regard to the work executed by the petitioner and the amount payable to him, and in view of the submissions of the learned Assistant Government Pleader, the respondent authorities more particularly 8th respondent is directed to pay a sum of SRK,J W.P No.14997 of 2023 5 Rs.2,31,199/- (Rupees two lakhs thirty one thousand one hundred and ninety nine only) to the petitioner within a period of six (06) weeks from the date of receipt of a copy of this order. 7. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
