The present petitions have been filed against the order dated 23.06.2025, whereby MSEFC council initiated arbitration proceedings and considered the respondent No.1 as supplier under Section 2(n) in a works contract under the provisions on the Micro Small and Medium Enterprises Development Act, 2006. 2. Learned counsel has submitted that the present is a subsequent round of litigation and that in the first round of [2026:RJ-JP:13756] (3 of 3) [CW-5959/2026] litigation, the concerned Court has directed for consideration of preliminary issue prior to adjudication of the matter on merits. 3. Caveator has marked presence. It is submitted that the present petitions have become infructuous as on date, as the order impugned dated 23.06.2025 has merged with final order dated 17.03.2026. It is also submitted that after passing of preliminary order, petitioners have duly participated in the proceedings before the Court concerned. 4. Heard. 5. In light of the subsequent developments, the present petitions are disposed of. Pending applications, if any, stand disposed. 6. However, petitioners are at liberty to challenge not only the present impugned order but also the final order dated 17.03.2026, if they are aggrieved by the same. 7.
