The petitioners are apprehending their arrest in connection with Barkagaon PS Case No.263 of 2025, for offence registered under section 317(2), 3(5) of BNS, 2023 and section 30(ii) of Coal Mines Act and Section 33 of the Indian Forest Act, pending in court of learned J.M.F.C., Hazaribagh.

Learned counsel for the petitioners submits that the petitioners happened to be owner of different tractors and the allegations are made that three tons coal was loaded on each of said tractor. He next submits that the petitioners are having no criminal antecedent as disclosed in paragraph no.10 of the petition and co- accused has been granted anticipatory in ABA No.1606 of 2026.
4. Learned State counsel opposes prayer and submits that illegally the said coal was loaded on the said tractors.

Considering that the petitioners happened to be owner of the two different tractors and the petitioners are having no criminal antecedent as aforesaid and co-accused has been granted anticipatory in ABA No.1606 of 2026,and in that view of the matter, the petitioners, above named, are, hereby, directed to surrender before learned court within two weeks from today, and learned court shall release the petitioners, above named, on such terms and conditions as well as sureties as the learned court may deem fit and proper.
6. This petition is disposed of.
