Side) ******* https://www.mhc.tn.gov.in/judis Crl.O.P.No.22166 of 2026 2/9 ORDER The petitioner, who was arrested and remanded to judicial custody on 13.07.2026, for the offences punishable under Section 303(2) of BNS @ 303(2), 317(4) and 317(5) of BNS in Crime No.201 of 2026, registered on the file respondent police, seeks bail. 2. The case of the prosecution is that, based on the complaint lodged by the defacto complainant regarding theft of his two wheeler, the respondent has registered a FIR and during the course of investigation, it is found that the other accused involved in this case have stolen the defacto complainant’s two wheeler and gave it to the petitioner herein, who is running a two wheeler mechanic shop, for dismantling it. Hence, this case. 3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case, based on the confession of the co-accused. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. https://www.mhc.tn.gov.in/judis Crl.O.P.No.22166 of 2026 3/9 4. The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and on instruction submitted that the stolen property has been recovered; that the petitioner has no previous cases; and that the investigation is pending. 5. Heard both sides and perused the materials available on record. 6. Considering the facts and circumstances of the case, the fact that the petitioner has no previous bad antecedents and also the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner with certain conditions. 7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to the satisfaction of the Special Court for Exclusive Trial for POCSO Case, Cuddalore and subject to the following conditions: https://www.mhc.tn.gov.in/judis Crl.O.P.No.22166 of 2026 4/9 [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders; [c] the petitioner shall not abscond either during investigation or trial; [d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions had been imposed and the petitioner released on bail by the learned Magistrate/Trial Court itself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [f] if the petitioner thereafter absconds, a fresh FIR may be registered under Section 269 of the Bharatiya Nyaya Sanhita, 2023. 11.08.2026 stn https://www.mhc.tn.gov.in/judis Crl.O.P.No.22166 of 2026 5/9 Note: 1. In view of the submissions made, Paragraph No. 7 and the 'Copy to' portion of the order dated 11.08.2026 in Crl.O.P. No. 22166 of 2026 shall stand modified and the words ‘The Special Court for Exclusive Trial of POCSO Cases, Cuddalore’ shall be replaced with ‘District Munsif-cum- Judicial Magistrate, Neyveli’. 4.
