WP No. 30660 of 2026 __________ Page2 of 6 Prayer: This writ petition is filed under Article 226 of the Constitution of India, seeking writ of mandamus directing the respondents to pay the petitioner interest at the rate of 18 percentage per annum, the period of delay from 01.07.25 to 10.03.26 in paying the amounts paid towards his terminal / pension benefits namely EPF Employees Contribution, Gratuity, Encashment of leave and Commuted Value of pension. WP No. 30668 of 2026 Prayer: This writ petition is filed under Article 226 of the Constitution of India, seeking writ of mandamus directing the respondents to pay the petitioner interest at the rate of 18 percentage per annum, for the period of delay from 01.03.25 to 10.03.26 in paying the amounts paid towards his terminal / benefits namely EPF Employees Contribution, Gratuity, Encashment of leaves/ already Surrendered Earned Leave. WP No. 30660 of 2026 __________ Page3 of 6 Order These writ petitions have been filed seeking interest for the belated payment of terminal benefits to the petitioners. 2.The case of the petitioners is that they were appointed in the respondent corporation in the years 1989 and 1998 respectively and retired from service on attaining the age of superannuation in the year 2025. However, the terminal benefits have been settled to the petitioners belatedly and no interest has been paid for the delayed period. Therefore, the petitioners had submitted representations to the respondents dated 02.07.2026 and 21.04.2026 respectively, to pay interest for the delayed period. Since the same was not considered, the present writ petitions have been filed.
3.The learned Standing Counsels would fairly submit that they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount. 4.Heard the learned counsel for both sides and perused the materials available on record. https://www.mhc.tn.gov.in/judis
WP No. 30660 of 2026 __________ Page4 of 6 5.In view of the above submission of the learned Standing Counsels, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioners within a period of six weeks from the date of receipt of a copy of this order. 6.With the above direction, these writ petitions are disposed of.
