KOMARA PRUDHVI RAJ The Court made the following: ORDER Heard Sri V. Sai Kumar, learned counsel for the petitioner and Sri Komara Prudhvi Raj, learned counsel for the respondent. 2. The sole defendant in the suit O.S.No.68 of 2025 on the file of the learned Principal Civil Judge (Junior Division), Kavali, SPSR Nellore District, filed this civil revision petition (hereinafter referred to as ‘revision’) complaining that I.A.No.193 of 2025 has not been disposed of. 3. The respondent/plaintiff instituted O.S.No.68 of 2025 seeking perpetual injunction restraining the defendant, her men, assignees and her legal representatives from evicting the plaintiff forcibly from the plaint schedule property without following due process of law. 4. Along with the suit, the plaintiff filed I.A.No.193 of 2025 under Order XXXIX Rules 1 and 2 read with Section 151 C.P.C. The trial Court granted ad- interim injunction on 10.03.2025. 5. Thereafter, the revision petitioner/defendant filed a counter in I.A.No.193 of 2025 and reported ready for enquiry. However, the interlocutory application is being adjourned from time to time. Hence, the above revision was filed. 6. Considering the prayer in the revision, this Court called for information from the trial court regarding the stage of I.A.No.193 of 2025. 7. As seen from the information received through WhatsApp, pending the enquiry in I.A.No.193 of 2025, the plaintiff filed I.A.No.615 of 2025 to implead the proposed party as defendant No.2, and the said application was allowed on 30.06.2026, and a neat copy of the plaint was filed on 14.07.2026. 8. It is relevant to note that Order XXXIX Rule 3-A mandates that where an injunction is granted without giving notice to the opposite party, the Court shall endeavour to dispose of the application within thirty days from the date when the injunction was granted. If the Court is unable to do so, it shall record reasons for such inability. 9. In the present case, the ad-interim injunction was granted on 10.03.2025. Though the defendant has filed a counter and reported ready for enquiry, the application is still pending. 10. Given the discussion above, this Civil Revision Petition is disposed of at the admission stage, directing the trial court to dispose of I.A.No.193 of 2025, as expeditiously as possible, preferably within six weeks from the receipt of a copy of this order, keeping in view the mandate contained under Order XXXIX Rule 3-A C.P.C. as also Nama Ramaprasad vs Kristam Reddy Raju1.
