MR.N.PALANIVEL, GOVT.ADVOCATE (CRL.SIDE) ORDER The petitioner apprehends arrest for the alleged offences under Sections 34, 406 and 420 of IPC in Crime No.0228 of 2025 on the file of the respondent police seeks anticipatory bail. 2. The case of the prosecution is that the petitioner, along with the co- accused, misappropriated a huge sum of money from the de facto complainant, thereby cheating him. Hence, the present case was registered. 3. Today, when the matter is taken up for hearing, there is no representation for the petitioner. 4. The learned Government Advocate (Crl.Side) appearing for the respondent strongly opposed the grant of anticipatory bail to the petitioner on the ground that the petitioner has got one previous case pending against him. https://www.mhc.tn.gov.in/judis

5. From the submissions made by the learned Government Advocate (Criminal Side), it is evident that the petitioner has a previous case registered against him, which clearly demonstrates that he has misused the liberty of anticipatory bail granted to him on earlier occasions. This Court is of the view that if the petitioner is enlarged on anticipatory bail, it may embolden him to indulge in similar offences in the future without fear of the law. Consequently, given that there is no change in circumstances, and taking into account the larger interest of society, this Court is not inclined to grant anticipatory bail to the petitioner. 6.
