2026:JHHC:10748 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.(C) No. 2081 of 2023 Binod Kumar, son of late Sunil Kumar Varman, resident of Gandhi Nagar Sabjee Bagan Tadi Godam, P.O. Dhanbad, P.S. Dhansar, District- Dhanbad. .... Petitioner(s) -Versus- 1. The State of Jharkhand through the Secretary, Food Supply and Consumer Department, Govt. of Jharkhand, at Project Bhawan, Dhurwa, Ranchi. 2. The Secretary, Food Supply and Consumer Department, Govt. of Jharkhand, at Project Bhawan, Dhurwa, Ranchi 3. The Deputy Commissioner, Dhanbad. 4. The Additional District Magistrate (Supply), Dhanbad. .... Respondent(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the petitioner(s): Mr. Niranjan Singh, Advocate. For the respondent(s): Mr. Mithilesh Singh, GA-IV Mr. Bhanu Pratap, AC to GA-IV. ------ 07/15.04.2026: In this writ petition, the petitioner, who is a P.D.S. dealer, has prayed for direction upon the respondents to allot and issue foodgrains for the month of September, 2021, which was not supplied to the petitioner. It has further been prayed for correction of Closing Balance Index Portal for the period from the month of October, 2021 till August, 2022 in which the lesser quantity of foodgrains were supplied from the godown than the quantity shown in the Closing Balance Index. 2. The first prayer of the petitioner cannot be granted as the petitioner is claiming allotment of foodgrains for the month of September 2021. Since the petitioner is a PDS Dealer, if he has not received allotment for the month of September 2021, naturally he could not have distributed the foodgrains. In the year 2026, there cannot be any direction to supply foodgrains, which was supposed to be distributed in September 2021. 3. So far as second prayer is concerned, he is praying correction of closing balance index for the month of October, 2021 till August, 2022. It is the case of the petitioner that he was supplied with lesser quantity of foodgrains, which actually ought to have been supplied to him and the incorrect entry was also made in this context. This prayer cannot be accepted as this is a question of disputed fact. 4. In that view, no relief can be granted to the petitioner in this writ petition. Accordingly, the same is dismissed. Pending interlocutory applications, if any, stand disposed of. 15th April, 2026. (ANANDA SEN, J.) Anu-Cp2. Uploaded on: 17.04.2026.
