For Petitioner : Mr.M.R.Dhalapathy Vignesh Kumar For Respondents : Mr.C.Prabakaran Special Government Pleader ***** O R D E R The petitioner has approached this Court challenging the refusal order dated 18.06.2026 passed by the second respondent, rejecting the petitioner’s application for approval to form a residential layout in S.F.Nos.829/1, 830/1, 834/2 and 837/3A3B2, Vellalore Village, Madhukarai Taluk, Singanallur SRO, Coimbatore, measuring 17,057 sq.mts. 2. The petitioner, being the owner of the said lands, submitted an application seeking approval to form a residential layout. The application was rejected on the ground that S.F.No.829/1 falls within the agricultural zone as per the Coimbatore Master Plan. https://www.mhc.tn.gov.in/judis W.P.No.28835 of 2026 Page Nos.3/5 3. Learned counsel for the petitioner submits that, as per the Coimbatore Master Plan, the said land is designated for residential use and, therefore, the rejection of the application is arbitrary. 4. The learned State Counsel does not dispute that a portion of the land falls within the residential zone. However, he submits that the petitioner’s application can be considered only upon the petitioner furnishing all the required documents. 5. In view of the above, the impugned refusal order cannot be sustained. 6. Accordingly, the Writ Petition is allowed. The impugned refusal order dated 18.06.2026 passed by the second respondent is quashed. The second respondent is directed to reconsider the petitioner’s application and grant approval, excluding any portion of the land that falls within the agricultural zone, subject to the petitioner satisfying all other applicable requirements.
