Order 13/03/2026 This writ petition has been filed by the petitioners challenging the order dated 17.01.2020 passed by the Central Administrative Tribunal, Jaipur Bench in Original Application No.238/2016. This Court on 26.11.2021 passed the following order:-
“Heard on prayer for vacating stay. According to the learned counsel for the respondent, the respondent was granted regular promotion vide order dated 22.05.2013, therefore, she could not be reverted subsequently on
30.03.2016.
Learned counsel for petitioner-Union of India would submit that the respondent had accepted her promotion vide order dated 22.05.2013 with an open eye that she will have to suffer reversion, if other employee Smt. Lorita Trawaso is repatriated. As Smt. Lorita Trawaso was repatriated, the respondent had to be reverted.
[2026:RJ-JP:10596-DB] (2 of 2) [CW-8672/2020] After hearing learned counsel for the parties, it has transpired that now respondent has been granted regular promotion vide order dated 24.07.2020. In view of the above, the interim
order which has been passed by this Court will not come in the way of continuance of the respondent on the higher post by virtue of order of promotion dated
24.07.2020. However, whether she was entitled to seniority with effect from the original date of promotion or form 24.07.2020 will be decided in this petition. The appeal is admitted for final hearing. Matter be listed for final hearing. Application for vacating stay stands
disposed off.” Today, counsel for the parties informed the Court that the respondent has retired from service after attaining the age of superannuation on 31.08.2022. Counsel for the respondent(s) submits that the respondent has already retired from service after working on the promotional post and she is happily enjoying her retiral life and she will not claim any further benefits from the department. Counsel for the petitioners has no serious objection to the submission made by counsel for the respondent. Since, the employee has already been retired, the petitioners are directed not to take any coercive action against her in future. In that view of the matter, this writ petition stands disposed of.
