GA JUSTICE ANOOP KUMAR DHAND Order 02/04/2026 1. By way of filing the instant petition, a challenge has been led to the impugned order dated 16.01.2019 passed by the court of the Judicial Magistrate Rajakheda, District Dholpur by which the application submitted by the petitioner seeking supurdagi of the vehicle in question with registration No. RJ-11-PA-0851 has been rejected. 2. Aggrieved by the aforesaid order a revision petition was submitted by the petitioner before the Court of the Special Judge, SC/ST (Prevention of Atrocities) Act Cases, District Dholpur. However, the same was rejected vide order dated 02.03.2019. 3. While rejecting the aforesaid revision petition, a liberty was granted to the petitioner to file fresh application before the learned Magistrate. In case, Final Report (Negative) is submitted by the Police before the Concerned Court. [2026:RJ-JP:13755] (2 of 2) [CRLMP-6460/2019] 4. Learned Public Prosecutor on the basis of the factual report dated 31.03.2026 furnished by the S.H.O. of Police Station Diholi, District Dholpur has apprised this Court that the Final Report (Negative) has been submitted against the petitioner & in favour of the accused Rajendra and Radheshyam and a prayer has been made for their release under Section 169 Cr.P.C. Counsel further submits that a decision has been taken to file complaint against the accused Anil, Sunil, Beenu and Asharam under Section 193, 120-B IPC and accordingly, complaint has been submitted against them for the abovestated offences before the Court of learned Judicial Magistrate, Rajakheda, on 24.01.2023. 5. Considering the overall facts and circumstances of the case, the instant petition stands disposed of reiterating the order passed by the Revisional Court, this Court grant liberty to the petitioner to file a fresh application for release of the subject vehicle before the Court of learned Magistrate, who will pass fresh appropriate order after hearing both sides, strictly in accordance with law. 6.
