... For the State. Learned advocate appearing for the petitioner submits that the petitioner is similarly placed as other accused person viz. Md. Mainul Sk @ Monirul Islam @ Bhodu Sk. The subject-matter of the case involves 3.476 kgs. of brown sugar and it has been alleged that petitioner was in contact with the principal accused. Learned advocate for the petitioner submits that the petitioner surrendered on 08.07.2025 and since then, he is in custody for more than six months. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are communications between the petitioner and the principal accused. However, records reflect that in six months, there
2 were two communications. One of such communication obviously was in close proximity of time of commission of the offence. Be that as it may, prima facie, it reflects from the charge-sheet that CDRs have not been relied upon. Having regard to the period of custody undergone and there was no recovery from the present petitioner and petitioner has been implicated on the basis of statement of co-accused, I am of the view that further detention of the present petitioner in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Manirul Islam @ Monirul Islam @ Maina shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Special Court under the NDPS Act-cum-Additional District Judge, 4th Court, Malda.
If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 1426 of 2025, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
