Nawaz for the petitioner Khairul Islam, who has filed this application under Section 483 of the BNSS, 2023 with a prayer for bail as he is behind bars since 15.01.2026 in connection with Gossaigaon PS Case No. 10/2026 under Sections 25(1)(a) of Arms Act. 2. Mr. R. J. Baruah, learned Addl. Public Prosecutor is present for the Page No.# 2/2 respondent State. 3. The petitioner was behind bars for 62 days and by order dated 18-03- 2026, he was released on interim bail. 4. The allegation against the petitioner is that a firearm was recovered from his garage without any supporting documents. 5. The Additional Public Prosecutor has raised objections stating that that there are incriminating materials in the case diary against the petitioner and the firearm which was recovered is a serviceable firearm and the petitioner has also failed to produce any documents of purchasing the firearm during their investigation. 6. I have considered the submissions at the bar with circumspection. I have considered the progress of the investigation. 7. After perusing the case diary it appears that custodial detention may not be required for the progress of the investigation. Thereby, the interim order dated 18-03-2026 is made absolute under the same terms and conditions. 8. Send back the Case Diary. JUDGE Comparing Assistant
