ORDER The petitioner, who was arrested and remanded to judicial custody on 29.07.2026 for the alleged offence under Sections 126(2), 309(4), 311, 351(3) of BNS, in Crime No.197 of 2026 on the file of the respondent police, seeks bail. https://www.mhc.tn.gov.in/judis

2. The allegation against the petitioner is that the petitioner waylaid the de facto complainant and demanded money and when he refused, the petitioner allegedly brandished a knife against the complainant's neck and forcibly extorted a sum of Rs.400/- from him. Hence, the registration of the case.
3. The learned counsel for the petitioner submitted that the petitioner has been in judicial custody since 29.07.2026. He further submitted that the petitioner is innocent and no way connected with the offence and that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has 16 previous cases, out of which, three cases are under Section 302 IPC. Hence, he strongly oppose for the grant of bail to the petitioner.
5. I have given my anxious consideration to the submissions made by the
learned counsel on either side and perused the materials available on record.
6. Considering the nature of the allegations, the previous criminal antecedents of the petitioner and the investigation is still pending. In the event, https://www.mhc.tn.gov.in/judis
CRL OP No. 23113 of 2026 __________ Page3 of 4 if the petitioner is released on bail, he would abscond and may not appear before the Court by abiding the condition and would indulge in similar offences.
