The District Revenue Officer, Coimbatore District. ..Respondent(s) (5th respondent is impleaded suo motu by this Court) __________ Page1 of 6 https://www.mhc.tn.gov.in/judis WP No. 27389 of 2026 PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India seeking the issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned online order dated 25.02.2026 passed by the 3rd respondent in the petitioner’s online application No.2025/ 0105/ 12/ 725488 (transferred to new application ID 2026/ 0103/ 12/ 010455) dated 09.12.2025 and quash the same and consequently direct the 3rd respondent to correct the extent of the land as 3.35 acres instead of 3 acres in the patta No.453 which was issued in the petitioners name, in respect of the properties comprised in survey No.600/1 and survey No.601/2 situated at Vellanaipatty village, Annur Taluk, Coimbatore District. For Petitioner: Ms. S.Rithika For Respondent(s): Mr.M.Roshan Atiq Additional Government Pleader ORDER When the matter was taken up for hearing on 16.07.2026, this Court passed the following order:- “Mr.B.Pachaiyappan, learned Government’s counsel, takes notice on behalf of the respondents. 2. The learned counsel for the petitioner would submit that in this case, the petitioner had filed an application seeking for correction of measurement of the subject land in the patta copy. The said application was rejected vide the impugned online order __________ Page2 of 6 https://www.mhc.tn.gov.in/judis WP No. 27389 of 2026 dated 25.02.2026 on the ground that there is double registration. According to the petitioner, the 3rd respondent had neither issued notice nor conducted any proper enquiry prior to the passing of impugned order, which is violation of principles of natural justice. Hence, this petition. 3. In the case on hand, the application was filed by the petitioner seeking for correction of patta in respect of measurement of the subject property. There is no impediment for the 3rd respondent in entertaining the petitioner’s application. However, the said application was rejected vide the impugned order without assigning any proper reason. It was also submitted that no notice was issued and no proper enquiry was conducted by the 3rd respondent prior to the passing of impugned order. 4. Normally, when the respondents are intend to pass any adverse order, it is mandatory on their part to provide sufficient opportunity to the petitioner. However, in this case, the impugned order was passed, as a non-speaking order, in violation of principles of natural justice, which is not proper. 5. In view of the above, this Court directs the 3rd respondent to appear before this Court during the next date of hearing and explain as to under what circumstances, the impugned rejection order was passed. 6. Post this matter on 17.08.2026 for orders.” 2. Pursuant to the said order, the Tahsildar, Annur Taluk / 3rd respondent appeared before this Court today and submitted that since the petitioner sought a UDR correction, which can only be made by the District Revenue Officer, steps have been taken to forward the petitioner’s application to the said authority on 03.08.2026, and a communication to that effect was also sent to the petitioner. __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 27389 of 2026 3. In view of the above and since the District Revenue Officer has not been impleaded as a party to this Writ Petition, this Court suo motu impleads the District Revenue Officer, Coimbatore, as the 5th respondent. 4. Mr. M. Roshan Atiq, learned Additional Government Pleader, takes notice on behalf of the newly impleaded 5th respondent and submits that the representation of the petitioner dated 12.01.2026 will be considered and appropriate orders will be passed thereon within a time frame to be fixed by this Court. 5. Considering the facts and circumstances of the case, and the submissions made by both sides that the competent authority to effect a UDR correction is the District Revenue Officer (impleaded herein as the 5th respondent), this Court directs the District Revenue Officer, Coimbatore, to consider the petitioner’s representation dated 12.01.2026. The said representation seeks to correct the land extent from 3 acres to 3.35 acres in Patta No. 453 for the properties comprised in Survey Nos. 600/1 and 601/2, situated at Vellanaipatty Village, Annur Taluk, Coimbatore District. The 5th respondent __________ Page4 of 6 https://www.mhc.tn.gov.in/judis WP No. 27389 of 2026 shall pass appropriate orders thereon on merits and in accordance with law, after issuing due notice to all interested parties and affording an opportunity of personal hearing to the petitioner, within a period of six (6) weeks from the date of receipt of a copy of this order. Consequently, the personal appearance of the Tahsildar, Annur Taluk, Coimbatore District, stands dispensed with. 6. With the above directions, this Writ Petition stands disposed of.
