HON'BLE MR. JUSTICE SUDESH BANSAL HON'BLE MR. JUSTICE ASHUTOSH KUMAR Order 28/03/2026 Four petitioners jointly filed this contempt petition alleging disobedience of the final order dated 23.04.2019 passed in D.B. Civil Writ Petition No.14955/2017. Admittedly, D.B. Civil Contempt Petition No.33/2021 filed by the original writ petitioner for disobedience of the final order dated 23.04.2019 has been disposed of vide order dated 20.07.2023
[2026:RJ-JP:13079-DB] (2 of 2) [CCP-60/2026] and a liberty was given to her for revival of the contempt petition in case her grievance survives. Petitioners, without having any locus and without abiding with the previous order dated 20.07.2023 passed in D.B. Civil Contempt Petition No.33/2021, have preferred this fresh contempt petition, which is sheer misuse of process of law. Counsel for the petitioners, after arguing the contempt petition seeks permission to withdraw the same in order to avail the appropriate remedy for removal of encroachment, if exists, in accordance with law. In view of the above, instant contempt petition is dismissed as withdrawn. Notice(s) of contempt, if any, stands discharged.
