In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Nanak Singh @ Nanku, who has been accused in FIR No.416 of 2025, under Sections 109 (1), 115 (2), 191 (2), 191 (3), 351 (2) and 3 (5) of BNS, 2023 and under Sections 3/25 of the Arms Act, at Police Station Bazpur, District Udham Singh Nagar. 4. In a nutshell, the case of the prosecution is that informant uncle Gurmeet Singh having dispute with Kulwant Singh in relation to the water and on 26.11.2025, at about 3:30 PM, when the informant’s uncle son Surendra Singh and Gurmeet Singh went to their fields where Kulwant Singh, Nanak Singh, Jasvinder Singh, all resident of Jabran P.S. Bazpur, District Udham Singh Nagar, with other persons who were hiding at that place came out and assaulted the complainant and his uncle’s son, who were having Lathi and illegal weapon, and sustained injuries. 5. Learned counsel appearing on behalf of the Applicant submits that the Applicant has been falsely implicated in the present matter. He further submits that the Applicant been languishing in jail since 04.12.2025. 6. Learned State Counsel has vehemently opposed the bail application of the Applicant. 7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 8. Accordingly, bail application is allowed. It is directed that the Applicant - Nanak Singh @ Nanku, who has been accused in FIR No.416 of 2025, under Sections 109 (1), 115 (2), 191 (2), 191 (3), 351 (2) and 3 (5) of BNS, 2023 and under Sections 3/25 of the Arms Act, at Police Station Bazpur, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
