The aforesaid Criminal Original Petition was considered on its own merits and the petitioner was directed to be present for the preliminary inquiry and further action was directed to be taken depending on the outcome of the inquiry. Since they are in the nature of giving different versions of the same incident, it is just necessary that a single investigating officer investigate both the issues. In view thereof, the following sentence shall be included in paragraph 4 after the word possible: “let both the complaints be investigated by the same Investigating Officer and if necessary the jurisdictional Assistant Commissioner shall conduct the preliminary enquiry or pass orders entrusting both the matters to a single officer and shall also supervise the inquiry. Since the matter relates out of a matrimonial discord and inquiry by the Assistant Commissioner shall also conduct a session of enquiry so that the matter can also be amicably settled between the parties.” 3.
