Also heard Mr. S Das, learned Standing Counsel, Higher Education Department, Mr. R Boro, learned counsel appearing on behalf of Mr. C Baruah, learned Standing Counsel, Accountant General as well as Ms. B Borah, learned counsel appearing on behalf of Mr. D Upamanyu, learned Standing Counsel, Health Department. [2] Having regard to the nature of grievance projected by the petitioner, the writ petition is taken up for disposal at this stage. [3] It is the case of the petitioner that she is the wife of Late Juran Ali, who was a Lecturer of Bilasipara College and receiving family pension after the death of her husband. According to the petitioner, she has suffered from different ailments and for which she has undertaken medical treatment in different hospitals recognized by the State Government. On account of her medical treatment, she had to spend a sum of Rs.10,94,395/- by taking private loan. [4] According to the petitioner, she is entitled to medical reimbursement in terms of the communication issued to all the Administrative Departments/Heads of Departments by the Finance (Budget) Department on 04.08.1997 (Annexure- 2) and also Office Memorandum dated 30.06.2007 (Annexure-3) also issued by the Finance (Budget) Department, Government of Assam. The petitioner therefore submitted a representation for medical reimbursement before the Directorate of Higher Education on 20.09.2024 which was received by the Directorate on the same day. However, since no response was made, the Page No.# 3/3 petitioner again submitted another representation/reminder before the same authority on 16.06.2025. But as there was no response, the petitioner is before this Court. [5] Considering the above position, as projected by the petitioner, the writ petition is disposed of with a direction to the Directorate of Higher Education, Government of Assam to consider and dispose of the representation submitted by the petitioner on 20.09.2024 and the reminder on 16.06.2025 by way of a speaking order. It is also provided herein that upon such consideration, if the petitioner is found to be entitled to medical reimbursement in terms of the standing guidelines, the same shall be given to her without delay. [6] The representation of the petitioner be considered and disposed of within a period of 6 (six) weeks from the date of receipt of a certified copy of this order. The petitioner shall also submit a copy of the writ petition along with a certified copy of this order to the Directorate of Higher Education for doing the needful. JUDGE Comparing Assistant
