The instant interlocutory application is preferred by the applicant seeking its impleadment as party-respondent no. 8 in the accompanying writ petition, W.P.[C.] no. 663/2026. 3. The opposite party nos. 1 & 2 as the writ petitioners have preferred the accompanying writ petition seeking inter alia a direction to the State respondents to settle a plot of land measuring 17 Bighas, covered by Dag nos. 8 & 9 and Sheet no.
150, Mouza – Eraligool Waste Land Grant, Nilambazar Revenue Circle, District – Sribhumi, Assam [‘the subject-plot’, for short]. The applicant has averred that it is a registered Non Government Organization [NGO] and it has also submitted an application for reserving the subject-land as a grazing land and as such, it is a necessary party for consideration of the claim of the opposite party nos. 1 & 2 – writ petitioners in the accompanying writ petition. 4. Having regard to such projection made on behalf of the applicant, this Court is of the view that the applicant is a necessary party in the accompanying writ petition in view of the competing claims of the opposite party nos. 1 & 2 - writ petitioners and the applicant for the subject-land. Accordingly, the instant interlocutory application stands allowed. 5. Mr. Ahmed, learned counsel for the petitioners shall file an amended amended Cause- Title in terms of the Notification no. 79 dated 19.06.2023 before the Registry, within 3 [three] working days from today and on filing of such amended cause-title, the registry to cause necessary corrections in the cause-title as well as in the CIS.
