This is an application wherein petitioner has prayed for expeditious disposal of the application filed under Section 451 of the Code of Criminal Procedure in G.R. Case No. 887 of 2025 pending before the learned Additional Chief Judicial Magistrate Bidhananagr. Learned Counsel for the petitioner submits that by an order dated 11.11.2025, the Court below directed to call for a report from the Investigating Officer in view of the petition filed by the petitioner herein for de-freezing seven bank accounts mentioned in the said order. He further submits that thereafter at least seven dates have been fixed for hearing the said application but the Court below have not yet disposed of the said application and for which the petitioner is suffering a lot. Therefore, the petitioner prays for a direction upon the Court below for expeditious disposal of the application filed by the petitioner for de-freezing the said bank accounts. Having heard the learned Counsel for the petitioner, it appears that prayer made by the petitioner is innocuous and if any order is passed in terms of the aforesaid prayer the opposite 2 party will have no cause to prejudice and, as such, the service of copy of the application upon the opposite parties is dispensed with. Having heard the learned Counsel for the petitioner and that the prayer made by the petitioner is justified and required to be allowed for the ends of justice, the instant application being CRR 476 of 2026 is hereby disposed of with the direction upon the Court below to dispose of the petitioner’s aforesaid application under Section 451 of the Cr. PC read with Section 487 of BNSS dated 11.11.2025 on the next date of hearing i.e., on 11th February 2026 or preferably within a period of two weeks thereafter. This order is passed invoking this Court’s jurisdiction under Section 529 of BNSS.
