(2) Petitioner was engaged as a daily wager in Rishikul Government Ayurvedic Pharmacy, Haridwar, reportedly in 2010. His engagement was discontinued by Superintendent of the concerned Pharmacy, vide order dated 10.1.2023. The reason indicated in the said order is that because of interim order passed by this Court against the E-tender notice for procurement of raw materials for producing medicines, manufacturing of medicines is suspended and it is not possible to pay wages to the workers engaged on daily wages in the Pharmacy. (3) Learned Counsel for the petitioner submits that the writ petition, in which stay order was granted against E-tender notice issued by the concerned Pharmacy, was dismissed as infructuous. He submits that after dismissal of writ petition, in which stay order was operating, the manufacturing of medicine must have begun, therefore petitioner has a right to be reappointed. (4) The reason assigned for disengaging petitioner from service does not suffer from any illegality or perversity, which may warrant interference. This Court, however, finds force in the submission made by learned Counsel for the petitioner that if medicine is being manufactured in 2026:UHC:4133 the Pharmacy concerned, then petitioner has a right to be considered for reappointment, if his work and conduct was found to be satisfactory. (5) Writ petition is, accordingly, disposed of by permitting the petitioner to approach the competent authority for his reengagement. If petitioner makes such application within one week from today, the competent authority shall consider his request for reengagement in the light of his past performance between 2010 to 2023.
