The petitioners are apprehending their arrest in connection with Jari PS Case No. 15 of 2026, for offence registered under section 303(2)/317(5)/ 3(5) of BNS, 2023 and Rules 4 and 54 of Jharkhand Minor Minerals Concessions Rules, 2004, Rules 7 and 9 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned Sub Divisional Judicial Magistrate, Gumla. 3. Learned counsel for the petitioner submits that the petitioner nos.1 and 2 are owner and driver respectively and the allegations are made that 100 cft sand was loaded on the tractor in question. He next submits that the petitioners are having no criminal antecedent as disclosed in paragraph no.10 of the petition. 4. Learned State counsel opposes prayer and submits that illegally the sand was being loaded on the said tractor. 5. Considering that petitioner nos.1 and 2 are owner and driver respectively and the petitioners are having no criminal antecedent as aforesaid, the petitioners, above named, are, hereby, directed to surrender before learned court within two weeks from today, and learned court shall release the petitioners, above named, on such terms and conditions as well as sureties as the learned court may deem fit and proper. 6.
