CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE CHALLA GUNARANJAN DATE : 21st July, 2026 3 HCJ & CGR, J WA_473_2026 & batch LISA GILL, CJ: All the above said appeals are taken up together for hearing and adjudication at request and consent of learned counsel for parties as all the appeals arise out of common order, dated 11.12.2025. 2. Question which arose in all writ petitions from which present appeals emanate, was whether appointments made to the post of Chairman/Chairperson of Agricultural Marketing Committees were in order. Issue was regarding distribution of 50% reservation among the categories of BCs, SCs, STs and minorities in terms of Section 8 of Andhra Pradesh (50 Percent Reservations to BCs, SCs, STs and Minorities in all the Nominated Posts) Act, 2019 (for short, ‘Act of 2019’) and Andhra Pradesh (50 Percent Reservations to BCs, SCs, STs and Minorities in all the Nominated Posts) Rules, 2019 (for short, ‘Rules of 2019’). 3. Shorn of unnecessary detail, it is to be noted that the ‘State’ had to be taken as a unit for the purpose of implementation of provisions of Act of 2019 and Rules made thereunder. However, Collectors of various districts issued proceedings taking ‘District’ as a unit and fixed rosters in consonance with the Rule of Reservation (for short, ‘RoR’) in pursuance of memo dated 06.12.2024, wherein it is stated that ‘District’ is to be taken as unit for implementation of RoR for Chairman of Agricultural Market Committees. 4 HCJ & CGR, J WA_473_2026 & batch 4. Subsequently, memo dated 10.10.2025 was issued by Government clarifying that for purpose of determining reservations to Agricultural Market Committees, it is the State which is to be taken as a unit and not the District. 5. Learned Single Bench, on considering facts and circumstances, concluded that all actions subsequent to fixation of RoR in terms of memo, dated 06.12.2024 were not sustainable. Therefore, writ petitions challenging said appointments were allowed. G.O.Rt.No.593, dated 10.07.2025; G.O.Rt.No.855, dated 29.09.2025; and the second proceedings in Rc.No.168/SMA/2024, dated 14.08.2025, in which no reservation was provided to community of ST were all set aside. Relief in writ petitions was limited to petitioners therein. 6. Aggrieved therefrom, present appeals have been filed by respondent - State along with two others. 7. Learned Advocate General submits that without going into merits of the matter, present appeals may be disposed of as State is committed to taking action in strict accordance with provisions of Act of 2019 and specifically Section 3 thereof as well as Rule 3 of Rules of 2019. 8. We are informed that terms of incumbents of the post in question in W.A. Nos.474 and 478 of 2026 have come to an end, therefore, said writ appeals in any case are rendered infructuous. 5 HCJ & CGR, J WA_473_2026 & batch 9. It is further informed that order passed in W.P.No.31490 of 2025, whereby appointment of M. Jyothi Sudhakar Naidu made vide G.O. dated 29.09.2025 was set aside, has not been challenged in appeal by said incumbent. 10. Learned Advocate General submits that incumbents in question in W.A. Nos.477 and 479 of 2026 whose terms come to an end on 29.09.2026 and 14.08.2026 respectively shall not be disturbed. 11. Keeping in view the specific stand and statement of learned Advocate General, all these appeals are disposed of in the said terms. Needless to say, the State would take action in accordance with the applicable Act and Rules framed thereunder. No costs. Pending application(s) if any stand(s) disposed of accordingly.
