Learned counsel for the parties are present.
2. This contempt petition has been filed for initiation of contempt proceedings alleging willful non-compliance and disobedience of

3. Learned Senior counsel for the petitioners submits that it has come on record that prior to the order passed by this Court in W.P.(S) No. 4823 of 2014 on 13.10.2022, the posts were already surrendered. However, the State did not bring this fact to the knowledge of this Court in the writ proceedings which remained pending since 2014. The learned Senior counsel submits that if that be the position, the opposite parties ought to have filed a review petition before this Court, but they preferred an appeal instead, and the appeal was dismissed. Thereafter, they passed an order dated 03.12.2025 mentioning that the posts were already surrendered. She submits that this has caused great harassment to the petitioners and therefore, they are required to be compensated.
4. After hearing the learned counsel for the petitioner, this Court finds that on the day the order of the writ court was passed in W.P.(S) No. 4823 of 2014, by way of policy decision the posts were already surrendered and therefore, the order of this Court was not capable of being implemented. The fact remains that the State did not file any review petition but in spite of that, the order of this Court was not capable of being implemented and therefore, there is no question of deliberate and willful non-compliance of the order passed by this Court.
5. This contempt proceedings is accordingly dropped.
6. Pending interlocutory application, if any, is dismissed as not pressed.
