According to the prosecution story in brief is that he complainant has made written complaint before the concerned police station that on VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.04.16 13:53:39 +0530 2 / 3 date of incident there was dispute in between parties regarding previous enmity and thereafter, the accused persons have assaulted upon the injured person by danda as resultant the injured person was received simple injuries. The applicant submits that he is innocent and has been falsely implicated in the alleged offence and has not committed any act as alleged by the prosecution. It is further submitted that all the parties belong to the same locality and there exists previous enmity between them, due to which the applicant has been falsely implicated. The applicant neither assaulted the injured person nor committed any of the offences alleged against him. It is also submitted that the injuries sustained by the injured are simple in nature and not grievous. According to the applicant, he has been arrayed as an accused merely on the basis of suspicion and false allegations. It is further contended that no ingredients of the offences punishable under Sections 294, 323, 506, 326 and 34 of the IPC are made out against him and that the prosecution has not collected sufficient material regarding the alleged theft of the article. Therefore, looking to the material available on record, no prima facie case is made out against the present applicant. The applicant further reserves his right to raise additional grounds at the time of hearing of the bail application. 4. On the other hand, learned State counsel appearing for the respondent/State opposes the bail application and submits that the 3 / 3 present applicant was an absconder in the year 2024. He further submits that the applicant has four criminal antecedents and that the charge-sheet has already been filed before the competent Court. As such, it is contended that the applicant is not entitled to the grant of bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the nature and gravity of the offence, the material available in the case diary, and the fact that the applicant had absconded in the year 2024 and was arrested only on 07.03.2026, this Court is of the opinion that there is every likelihood that the applicant may abscond again if released on bail, which would adversely affect and hamper the trial. In view of the applicant’s conduct and the seriousness of the allegations, this Court is not inclined to enlarge the applicant on regular bail. Accordingly, the bail application deserves to be rejected. 7. Let the bail application of the Applicant - S. Pawan Rao, involved in Crime No. 123/2024 registered at Police Station Khamhardih District - Raipur (C.G.) for the offence punishable under Sections 294,323, 506, 326 & 34 of the IPC, is rejected.
