expenditure incurred by them under the Reimbursement of Tuition Fee (RTF) scheme for the students admitted in the academic years 2018-19, 2019-2020 and 2020-2021 a sum of Rs. 89.37 Lakhs towards RTF for obvious reasons as being arbitrary, illegal and violating Articles 14, 16, 19 and 21 of the Constitution of India and also in contravention of the GO Ms No. 115, Social Welfare Department, dated 30-11-2019 and consequential Government Orders, and consequently direct the Respondents to release the admitted amount to a tune of Rs.
89.37 Lakhs towards Reimbursement of Tuition Fee (RTF) of both Fresh and Renewals for the students admitted in the academic years 2018-2019, 2019-2020 and 2020-2021 directly to the Petitioners Organization as all students admitted in these years have completed their courses and left the college by collecting their certificates and the college has not collected any amount of tuition fee from the said batches of students of the said years, together with interest thereon 24 percentage per annum and issue IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may kindly direct the respondents to atleast release the half of the total amounts (Rs. 89.37 Lakhs) which is including interest at 24% per annum that are due to the petitioner’s college forthwith and issue Counsel for the Petitioner:

Heard Sri S.S. Bhatt, learned counsel for the petitioner and the learned Assistant Government Pleader for Social Welfare. 2. The petitioner is an educational institution managed bySahaaya VoluntaryOrganisation, Hyderabad. Thepetitoner Institution is a self-financing, unaided institution. The petitioner is seeking reimbursement of Tuition Fee for the academic years 2018-19 to 2020-21 in respect of students admitted to the MBA course. 3. It is contended that the Government of Andhra Pradesh, in partial modification of the earlier GOs relating to issuance of post-metric scholarships for all the students belonging to SC, ST, BC, EBC, Minority communities and Differently Abled categories, for pursuing post-metric courses, namely ITI to Ph.D, in collaboration with the Central Government, issued two G.O.Ms.No.81 dated 07-05-2018 and G.O.Ms.115 dated 30-11-2019. In Clause 4 of the said G.O.Ms.115 dated 30-11-2019, the amounts eligible to be sanctioned in favour of every eligible student has been mentioned.
Under the said scheme, the Tuition Fee reimbursement RTF would be credited to the respective account of the college and the maintenance fee (MTF) would be remitted to the account of the respective student/parent. 4. It is contended that the students were allotted to the petitioner’s Institution under convener quota in – AP ICET. The respective students would

apply for scholarship in ‘Janmabhumi’ portal of Social Welfare department, on the basis of the said application, Tuition Fee reimbursement (RTF) would be credited to the college account. The petitioner's grievance is that, from the academic years 2018-19 to 2020-21, the amounts to be reimbursed to the petitionerInstitution have been kept pending. In case of those students who are eligible for reimbursement the college would not collecttuition fees from students rather claims reimbursement from the government. Upon admission of such students to the college, the college is entitled to reimbursement. 5. The petitioner contends that it incurs substantial expenditure towards payment of salaries to the teaching and non-teaching staff of the college/institution, providing and maintaining infrastructure facilities in the college, and other miscellaneous expenditure, which is inevitable. All the said sums have been expended even before the reimbursement from the Government is received. The arrears from over the period have been accumulated and are running into several Lakhs of Rupees.Thus approached the Court seeking a direction to the respondents to remit the sums due to the petitioner Institution forthwith, in the light of G.O.Ms.No.115 dated 30-11-2019 and the subsequent G.O.s., issued on the subject issue. 6. The learned counsel for the petitioner relies on the order passed by the Coordinate Bench of this Court in W.P.No.23625 of 2025 dated 05-03-2026 prays for passing of the similar order. 5
7. The learned Assistant Government Pleader, based on the written remarks received by him, submits that the claim of the petitioner requires verification with reference to the ‘Janmabhumi’ Portal and the existing G.Os. 8.
Having regard to the contentions advanced, placing reliance on the decision rendered by Coordinate Bench in W.P.No.23625 of 2025 dated 05-03-2026, the Writ Petition is disposed of directing the respondents to verify the claim of the petitioner with reference to the ‘Janmabhumi’ portal, after such verification, the amounts due to the petitioner shall be remitted within a period of four (04) months from the date of receipt of this order. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ______________________________ JUSTICE KIRANMAYEE MANDAVA
