ORDER This Civil Revision Petition has been filed under Article 227 of the Constitution of India against the order passed by learned XX Assistant Judge, City Civil Court, Chennai, in I.A.No.4 of 2025 in O.S.No.4444 of 2024, dated 04.12.2025, wherein the Court below allowed the application filed by the respondents/plaintiffs under Order VI Rule 17 CPC and permitted amendment of the plaint.
2. Heard learned counsel for petitioner and learned counsel for caveator and perused the materials available on record. This Court also went through the impugned order.
3. The respondents are plaintiffs. The suit was filed seeking the relief of permanent injunction restraining the defendant association from taking up a particular agenda in the proposed General Body Meeting at any time without issuing a show cause notice to the plaintiffs to offer their explanation to the allegations made against them.
4. When the above suit was pending, the plaintiffs filed I.A.No.4 of 2025 seeking amendment of pleadings on the basis of a subsequent development that had taken place where a resolution was passed and they sought for the relief of https://www.mhc.tn.gov.in/judis
CRP No.4861 of 2026 __________ Page3 of 4 declaration. The Court below allowed the said application by an order dated
04.12.2025. Aggrieved by the same, the present revision has been filed.

In the considered view of this Court, the amendment that is sought to be made in the pleadings by the plaintiffs is regarding a subsequent development that took place during the pendency of the suit wherein a resolution was passed and the plaintiffs were removed from the primary membership of the association. In the light of this development, the plaintiffs wanted to seek the relief of declaration questioning the said resolution passed. The Court below found that the said relief sought for by the plaintiffs does not change the character of the suit and that no prejudice will be caused to the defendant since the defendant can always file an additional written statement and justify passing of the resolution.

This Court does not find any perversity in the reasoning given by the Court below warranting interference of this Court in exercise of its jurisdiction under Article 227 of the Constitution of India. The petitioner/defendant can always file an additional written statement and justify their stand for passing the resolution and for removing the plaintiffs from the membership. Hence, the
order passed by the Court below is sustained and the petitioner is permitted to file an additional written statement and take a stand. The Court below shall deal https://www.mhc.tn.gov.in/judis
