Elayaraj Kumar Special Government Pleader for R1 to R4 ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 2nd respondent to consider the petitioner's representation dated 13.06.2026. 2. The learned counsel for the petitioner submitted that the petitioner’s father, Late P. Sundaram, was the absolute owner of the property measuring 10 cents in S.No.100/7, having acquired the same under Sale Deed Doc.No.1652/1981. After his demise, the petitioner and other legal heirs succeeded to the property. However, respondents 5 to 10, without any right or title, obtained Patta No.59 without notice or enquiry and subsequently executed a Partition Release Deed dated 05.06.2026, Doc.No.10808/2026. Under these circumstances, the petitioner submitted a representation dated 13.06.2026 to the 2nd respondent seeking to conduct a detailed enquiry and to cancel Patta No. 59, __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 31304 of 2026 which was illegally obtained by the private respondents. However, the same has not been considered till date. Challenging the inaction on the part of the 2nd respondent, the petitioner is constrained to file the present Writ Petition. 3. In response, Mr. P. Elayaraj Kumar, learned Special Government Pleader appearing for the official respondents, submitted that the representation of the petitioner dated 13.06.2026 would be considered by the third respondent, who is the competent authority, and appropriate orders would be passed thereon, in accordance with law, after issuing notice to the private respondents, within a period of eight weeks. 4. Considering the facts and circumstances of the case and the submissions made on either side, this Court, without expressing any opinion on the merits of the case, directs the 3rd respondent/Revenue Divisional Officer to consider and dispose of the petitioner's representation dated 13.06.2026 seeking to cancel the patta obtained by the private respondents and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to the petitioner, the private respondents, and the interested parties, if any, within a period of eight (8) weeks from the date of receipt of a copy of this order. __________ Page4 of 6 https://www.mhc.tn.gov.in/judis WP No. 31304 of 2026 5.With the above directions, the Writ Petition stands disposed of.
