For Petitioner: Mr.P.Muthamizhselvakumar For Respondent: Mr.M.M.I.Khaleel Government Advocate (Crl.Side) ORDER The petitioner, who was arrested and remanded to judicial custody on 22.08.2025 for the alleged offences under Section 311, 111(2)(B) of the Bharatiya Nyaya Sanhita, 2023 in Crime No.872 of 2025 on the file of the respondent police, seeks bail. 2. The case of the prosecution is that the petitioner, along with other co- accused, committed robbery utilizing deadly weapons. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is further submitted that the petitioner was earlier detained under the Goondas Act, which was subsequently quashed by this Hon'ble Court on 29.04.2026 in H.C.P. No. 2114 of 2025. In the present case, the investigation is completed and the charge sheet has also been filed in S.C.No. 367 of 2025, currently pending on the file of the learned II Additional District and Sessions Judge, Tiruppur. It is further submitted that the trial has not yet commenced and the next hearing of the case is scheduled for 24.08.2026. He would further submit that the petitioner has been in judicial custody since 22.08.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for the grant of bail to the petitioner. 4. The learned Government Advocate (Crl.Side) appearing for the respondent, while opposing the grant of bail to the petitioner, reiterated the prosecution case and, on instructions, submitted that the petitioner has three previous cases, out of which two cases are similar in nature. 5. Though the petitioner has three previous cases, considering the facts and circumstances of the case, the submissions of the learned counsel on both sides and the period of incarceration undergone by the petitioner since 22.08.2025, this Court is inclined to enlarge the petitioner on bail, subject to certain conditions. 7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty-Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned II Additional District and Sessions Judge, Tiruppur and subject to the following conditions: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the Trial Court concerned daily at 10.30 a.m. until further orders; [c] the petitioner shall not abscond either during investigation or trial; [d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] on breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the https://www.mhc.tn.gov.in/judis CRL OP No. 22610 of 2026 __________ Page4 of 5 conditions had been imposed and the petitioner released on bail by the learned Magistrate/Trial Court itself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [f] if the petitioner thereafter abscond, a fresh FIR may be registered under Section 269 of the Bharatiya Nyaya Sanhita, 2023. 13-08-2026 NSL Note: 1.
