CRP.No.5128 of 2026 __________ Page2 of 5 For Petitioner: Mr.Y.Deva Arul Prakash
ORDER This civil revision petition has been filed under Article 227 of The Constitution of India wherein the Court below permitted the respondent/mother to have visitation rights to her child, who is aged about 7 years.
2. Heard the learned counsel for the petitioner.
3. This Court has carefully considered the submissions of the
learned counsel for the petitioner and perused the materials available on record and more particularly the impugned order.
4. The Court below took into consideration the fact that the child is aged about seven years and that it is in the custody of the father. Since the mother was asking for the custody, the Court wanted to first ensure that the relationship between the mother and the child is normalised. Hence, the Court below allowed the visitation rights in favour of the mother. https://www.mhc.tn.gov.in/judis

5. The learned counsel for the petitioner submitted that the child is not willing to see the mother.
6. In the considered view of this Court, the child has been in the custody of the petitioner for quite some time and therefore, naturally, the child did not want to spend time with her mother. However, attempts will have to be made to ensure that the child is not deprived of the love and affection of the mother just because the relationship between the petitioner and the respondent has reached a road block. Hence, all attempts must be made to permit the child to meet the respondent. However, if, ultimately, all the attempts fail, it is always left open to the petitioner to approach the Court below and seek for modification. As such, the impugned order passed by the Court below does not suffer from any perversity warranting the interference of this Court.
7. Accordingly, the above civil revision petition is dismissed. 21-08-2026 https://www.mhc.tn.gov.in/judis
