(TM) A No.48 of 2026 __________ Page No.2 of 4 O R D E R Trade Marks Application filed under Order XIV Rule 8 of Original Side Rules, read with Order IX Rule 9 of the Code of Civil Procedure, 1908 is filed to restore the petition (T)OP(TM) No.452/2023 which was dismissed for default by this Court, vide order dated 25.03.2026. 2. Learned counsel for the petitioner submitted that when the matter came up for hearing on 25.03.2026, due to inadvertent administrative lapse of noting down the correct hearing date, the matter was not properly reflected in the cause list records maintained by the petitioner. The non-appearance of the petitioner on the said date of hearing, was neither wilful or wanton and the same happened as the petitioner was under the bona fide impression that the matter was not listed on that day. Hence, the learned counsel prayed for allowing the present restoration petition. 3. The learned counsel for the first respondent, raised no objections to the present restoration petition.
