2. Heard learned counsel for petitioner and learned counsel for respondent and carefully perused the materials available on record. This Court also went through the impugned order. 3. In the considered view of this Court, the cross-examination cannot be sought for as a matter of right under the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 [for brevity 'the Act'] and it can only be invoked under two circumstances mentioned under Section 21(2) (a) of the Act. 4. In the case in hand, the first ground raised on the side of the petitioner is that the respondent is not the owner of the property as on the date when the eviction petition was filed. The second ground raised is that the petitioner could not have been the tenant since it is represented that the tenancy has started in the year 1990 when the petitioner was hardly 6 years old. Hence, according to the petitioner, the actual tenant has not been added as party to the proceedings. 5. In the considered view of this Court, these issues can be argued before the Court below and it does not require any cross-examination of PW-1. Therefore, it is left open to the petitioner to raise all the issues before the Court below, which will be considered on its own merits and in accordance with law.
