ORAL ORDER
Parties are present. By order dated 05.02.2026, the matter was referred for mediation. Report is received from mediation centre and the petitioner has handed over the demand draft bearing no.501984 dated 17.03.2026 for a sum of Rs.18 Lakhs to the respondent and the same is acknowledged in the order sheet.
2. The terms in the memorandum of settlement is placed before Court and prayed that petition may be disposed of in terms of settlement.
3. Memorandum of settlement reads as under:
"MEMORANDUM OF SETTLEMENT I. The above criminal revision petition being aggrieved by the (i) Judgment dated 02.03.2020 passed in Criminal Misc No.65/2018 by II Additional Senior Civil Judge and JMFC,

Shivamogga and (il) Judgment dated 06.11.2021 passed in Crl.A No.95/2020 before the I Additional District and Sessions Judge, Shivamogga.
II. The Petitioner and Respondent No.1 are husband and wife and their marriage was solemnized on 05.12.2011 at Shivamogga. The Respondent No.2 namely Arush was born out of their wedlock. The Respondent has filed a petition Crl. Misc No. 65/2018 under section 12 of Protection of Women from Domestic Violence Act, 2005 (D.V.Act) before the II Additional Senior Civil Judge and JMFC, Shivamogga. The said trial court passed
judgment dated 02.03.2020 ordering the Petitioner to pay a sum of Rs.25,000/- to each Respondents and deposit as security deposit an amount of Rs.10,00,000/- (Rupees Ten Lakhs Only) in the name of the Respondent No.2 for his medical and educational purpose. Further the Petitioner being aggrieved by the Impugned Trial Court
judgment preferred Crl.A No.95/2020 before the I Additional District and Sessions Judge, Shivamogga. The said Trial Court passed
judgment dated 06.11.2021 for reducing the maintenance amount Rs.20,000/- to the Respondent No.1 and Rs.15,000/- (Rupees Fifteen Thousand Only) to the Respondent No.2 and a sum of Rs.5,00,000/- (Rupees Five Lakhs Only) for security deposit in the name of Respondent No.2 for his medical and educational purpose. The Petitioner is aggrieved by both the Impugned Trial Judgment and the Impugned Appellate
Judgment and preferred this revision petition. III. The aforesaid petition was referred to mediation for resolving the dispute between the parties. During the course of mediation, the Petitioner and the Respondent No.1 and their respective advocates were present to resolve their disputes and they have agreed to the following terms and conditions:
1. In view of this settlement, the Petitioner has agreed to pay a sum of Rs.59,00,000/- (Rupees Fifty Nine Lakhs Only) to the

Respondent towards full and final settlement of all her claims against the Petitioner herein including arrears of maintenance and medical and educational expenses of the minor son. Out of the said amount the Petitioner has already paid a sum of Rs.13,70,000/- (Rupees Thirteen Lakhs Seventy Thousand Only). to the Respondent No.1 and receipt of which is acknowledged by the Respondent No.1. Further the Petitioner undertakes to pay a sum of Rs. 18,00,000/- (Rupees Eighteen Lakhs Only) to the Respondent No.1 by way of demand draft and the same shall be handed over to the Respondent No.1 on 18.03.2026 and remaining balance amount of Rs.27,30,000/- (Rupees Twenty Lakhs Thirty Thhousand Only) will be paid by the Petitioner to the Respondent No.1 by way of demand draft on or before 01.06.2026 and the Respondent No.1 has agreed for the same. 2. Both the parties state that they have no claims of whatsoever nature against each other with respect of maintenance, movable/immovable or to be acquired in future. 3. In view of this settlement the Respondent undertakes to withdraw MFA (FC) No.390/2023 pending on the file of High Court of Karnataka, Bengaluru and Cri. Misc No.224/2021 filed against the Petitioner pending on the file of IMFC-II, Shivamogga after the realization of the aforesaid agreed amount. 4. Both the parties agree to the terms and conditions mentioned supra. In case of default of payment by the Petitioner to the Respondent No.1 as agreed above, then the agreement shall be cancelled and the parties agree that the matter may be dealt with in accordance with law. - 5 -

5. The parties further state that there has been no collusion or force, fraud or any undue influence by any of the parties to enter into this compromise in the aforesaid manner. IV.
In view of the aforesaid agreement, both the parties pray that this Hon'ble court may be pleased to record settlement and dispose off the Revision Petition in terms of this agreement after the realization of the aforesaid agreed amount. V. The parties agree to appear this Hon'ble Court whenever the matter is listed with their I.D.Proof."
